GrowthOS – Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Growth OS platform, applications, APIs, and related services (collectively, the “Service”) provided by Growth Hackers Company, LLC., registered in the US (“Growth OS,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use Growth OS.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the organization you represent. The Service is intended for professional and business use only.

2. Account Registration

• You must create an account to access most features.
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• We may suspend or terminate accounts that violate these Terms or present a security risk.

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You must not:

1. Copy, modify, reverse engineer, or attempt to extract source code from Growth OS or any of its modules.
2. Upload, transmit, or store malicious code, unlawful, or infringing material.
3. Use the Service to build or train competing AI or SaaS platforms.
4. Interfere with or disrupt system integrity or security.
5. Access the Service using automated tools (bots, scrapers) except via our approved APIs.

4. Service Features

Growth OS provides an integrated suite of growth and marketing tools, including but not limited to:

• Content Creation for Long-form, sort-form and visual’s creation
• GEO (aka Search AI Optimization) for SEO and competitor insights
• Synthetic Personas & Virtual Focus Groups for market simulation and testing
• Growth Hacking Framework & Dashboards for experiment tracking
• Task Management & Workflow Automation
• Social Media Intelligence & Performance Marketing Modules
• Business Intelligence & Reporting

Features may be modified, improved, or discontinued at any time with or without notice.

5. Subscription & Payment

1. Access to premium features requires an active subscription plan.
2. Pricing, billing cycles, and available plans are published on our website or within the app.
3. Payments are processed securely through approved third-party payment providers.
4. All fees are non-refundable except where required by law.
5. We may suspend access for unpaid invoices or failed payment methods.

6. Intellectual Property

All intellectual-property rights in the Service, including software, AI models, templates, and documentation, belong to Growth Hackers Company, LLC or its licensors.
You retain ownership of your own content and data uploaded to the platform, but grant us a limited, revocable, non-exclusive license to host, process, and display it as needed to operate the Service.

7. Confidentiality & Data Protection

Both parties agree to maintain the confidentiality of any non-public information disclosed under these Terms.
Processing of personal data is governed by our Privacy Policy.
We comply with CCPA, GDPR, UK Data Protection Act 2018, and other applicable laws.

8. Service Availability & Support

• We strive for 99.9% uptime and enterprise-grade reliability.
• Scheduled maintenance or upgrades may temporarily limit access; advance notice will be provided where possible.
• Support is offered via in-app chat or email at support@growthhackers.com.

9. AI Outputs & Generated Content

Growth OS integrates generative AI systems.

• AI outputs are machine-generated and provided “as is.”
• Users are responsible for verifying factual accuracy, legality, and compliance of AI-generated content before external use.
• Growth OS disclaims any liability for damages arising from reliance on AI-generated material.

10. Termination

You may terminate your account at any time through your workspace settings.
We may suspend or terminate your access if you:

• Breach these Terms,
• Cause harm to the Service or its users,
• Fail to pay fees when due.

Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our retention policy.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available.”
We make no warranties—express or implied—regarding reliability, accuracy, or fitness for a particular purpose.
Use of the Service is at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law:

• Growth OS and its affiliates shall not be liable for indirect, incidental, or consequential damages.
• Our total liability under these Terms will not exceed the amount paid by you during the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Growth OS, its affiliates, and employees from any claims, damages, or losses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Changes to the Terms

We may update these Terms from time to time. The “Last updated” date will indicate the latest revision.
Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the US, without regard to conflict-of-law principles.
Disputes will be subject to the exclusive jurisdiction of the courts of California, US.
